1. Overview

This website is operated by Smoked Hour ("we", "us", "our"). By visiting smokedhour.com or purchasing from us, you agree to these Terms of Service ("Terms"), together with our Shipping Policy, Refund Policy and Privacy Policy. If you do not agree, please do not use the site. Our store is hosted on Shopify Inc.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. Our products are cocktail and beverage accessories; we do not sell alcohol. Any alcoholic beverages you prepare must be consumed legally and responsibly, and only by people of legal drinking age.

3. Products, safety and proper use

Our smoker kits use an open flame to burn wood chips. Use them only as described in the included instructions: on a stable, heat-resistant surface, away from flammable materials, children and pets, and never unattended. Let all parts cool fully before touching or storing. Do not inhale smoke directly. Butane is never included and must be purchased separately and handled according to its manufacturer's warnings. You are responsible for using the products safely; to the extent permitted by law, we are not liable for injury or damage caused by misuse, modification, or failure to follow instructions.

Product photos are illustrative. Wood grain, color and packaging may vary slightly. We may change or discontinue products at any time.

4. Prices, discounts and payment

Prices are in U.S. dollars and may change without notice. Quantity discounts (for example, Buy 2 or Buy 3) are applied automatically at checkout and cannot be combined unless stated. We may refuse or cancel any order, including orders with pricing errors, suspected fraud, or quantities beyond reasonable personal use; if we cancel a paid order, we will refund you in full. Payment is processed securely by our payment providers; we do not store full card details.

5. Digital content

The recipe guide (PDF) included with eligible orders is licensed for your personal, non-commercial use. You may not resell, republish or redistribute it.

6. Shipping, returns and refunds

Shipping and returns are governed by our Shipping Policy and Refund Policy. Risk of loss passes to you on delivery to the carrier-confirmed address.

7. Reviews and submissions

If you submit reviews, photos or other content, you grant us a non-exclusive, royalty-free license to use, display and reproduce it in connection with our store and marketing. You confirm that your content is your own, is truthful, and does not violate anyone's rights.

8. Intellectual property

All site content, including text, graphics, logos and the recipe guide, belongs to Smoked Hour or its licensors and is protected by law. You may not copy or use it without our written permission.

9. Third-party links and services

Our site may link to or use third-party services. We are not responsible for their content, policies or practices.

10. Disclaimer and limitation of liability

The site and products are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties, and our total liability for any claim relating to a product or order is limited to the amount you paid for that order. We are not liable for indirect, incidental or consequential damages. Some jurisdictions do not allow these limitations, so they may not apply to you.

You agree to indemnify and hold harmless Smoked Hour from claims arising out of your breach of these Terms or misuse of our products.

These Terms are governed by the laws of the United States and the state in which our business is registered, without regard to conflict-of-law rules.
